OH HELL YES! I punish idiocy and stupidity any chance I get.

Besides... pain & suffereing... could pay for college. Gonna try and max out on the insurance and get a lil more to cover other expenses.

Thanks for the thoughts everyone, sure does make me feel better.

I wouldn't try to push the insurance. Make them cover the damage, and medical, but don't try to push the pain and suffering too far, or they won't pay at all. Trust me on this, insurance companies will do whatever they can not to pay, doesn't matter that their client was completely in the wrong. I got hit on a bicycle, while riding in a parking lot, 5 months ago, and the insurance still hasn't paid, saying I tried to beat the car to the parking lot intersection (who tries to beat a car while riding a bicycle?). And the only money I was asking the insurance company for was: damage (I needed a new $60 bike), medical (ambulance bill, medical bills, crutches), and missed work (I couldn't work for a month and a half because I was on crutches). I didn't even try to get pain and suffering.

You pay the lawyer only if he wins. Any lawyer who tries to charge upfront for a case like that is suspect.

True, the best way to go with lawyers is to pay them a certain percentage of what they win you. But if you don't think you're going to be winning much, it would be better to not use a lawyer, because they'll try to take too much of your winnings.

ya but if its a "percenage" that the lawyer agrees to take before going through w/ the case....he can't take a cent more than it....but again, hes a lawyer.

But if the lawyer knows he's not going to win much, then he'll demand a higher percentage, so he can make enough money to make the case worth his effort.
