But Fault? Why does that matter? He died. His friends and family still miss him, his fiancee is still mourning him ten years on.
R was riding the white line on a wet road and he lost it because painted surfaces have sod all traction.
What I am trying to say to you is that it dosn't matter about legal or fault until it is way too late for someone, and if you don't pay more attention then that can be you.
In other words, if the VW driver had pushed you under the wagon then presumbly he would be at fault but you'd have still gone under the wagon and probably be dead.
Theres a difference between riding safely and riding legally.
