I'm talking about if the problem persists PAST the warranty period. It will be very difficult to go back to the manufacturer later unless they are made aware now.

Looking for proof of service and looking for remedial action for a persistant problem isn't the same. Having a paper trail of letters seeking assistance with the problem go a long way in the eyes of the law. Always register the letters so they have to be signed for, then you have proof of receipt for those letters. The receipts for service will help prove you went through the proper procedure to aleviate any potential damage to the bike due to the persistant problem.
