Did you do a breathalyzer or some test to prove that alcohol was in your system? Or where you hauled in because you had a cup in your hand?
I agree with Shake, that the law you broke was that you were intoxicated while being under the legal age.

Funny- I know a few guys who have been drunk in public and lost their license over 21... you just get it off your record in a year and they have it for life... hmmm...

Methinks certain parts of the story here are missing or not entirely truthful.
I bet the arresting officer would have a slightly different take on things.

Its not uncommon for minors to lose their driver's license for non-driving drinking offenses. Some states revoke minor licenses for other infractions as well. Statistically, kids who drink underage also drive drunk.
The state can't really punish you as a minor. They can fine you, but that is just punishing your parents. The offense is not enough to place you in a juvenile prison, so what can they do to punish kids? Easy; take away their license, the one thing they cherish most. The judge was smart...he knew how to punish you so you'd understand that you can't break the law.
Instead, you come here and whine about it. CA is safer without you on the road.
You say it sucks to be a minor. No, you were out on the street getting plastered and you and your buddies decided to hit cars with tree branches while you stood there and watched. It must suck to be a moron.

Hmmm. A group of drunk minors caught vandalizing vechicles.
You're just mad that you didn't see the cops soon enough to be able to put your beer down.
I'm not condoning drinking at 17, but damn dude, keep it to a buddy's basement or somewhere off the street!

Texas has a law that states if you are a minor and get convicted of any alcohol related offense, the court you are convicted in will suspend your driving privileges for 6 months. They don't give the judge the option of a slap on the wrist.
Also all the officer has to do is testify he smelled alcohol on your breath. No other tests are required. You do not have to be drunk, just a taste to put the smell on your breath will do the trick. States are very serious about minors drinking alcohol.

if you didn't take a breathalyzer (and you never should... plead the 5th amendment) just get a lawyer, the cop might not show in court and if what you're saying is true about picking up the cup that wasn't yours that you didn't drink out of then you should be able to get off the hook.
