Its harder to pursue a hit and run driver here. Most of the hit and run drivers out in these parts are illegal aliens. If its in Cali the cops wont touch an illegal for anything less than a serious felony because their state govt is very soft on illegals (the law requires that LE agencies turn all illegals they arrest over to ICE once they are done with them so they can be prosecuted for being in the US illegally).

In Arizona the cops usually just have the border patrol come and pick up any illegals they arrest on the spot so they will likely be back in mexico by the time your done filing your insurance claim.

Find out what the damages are and take him to small claims court.

+100 . I took my slumlord to court several years ago over a hundred bucks. I could have cared less about the money. I wanted him to know he wasn't going to rip me off and get away with it. If you go to court and he doesn't show up it's an easy win for you. Then the fun part is collecting the money. It will take some work but you can definitely garnish his wages. Don't be the victim Bro!

Justice is out there, you just have to go out and get it.

If there are no injuries/fatalities the insurance company is only going to send him a subrogation notice and when he inevitably doens't pay them they will just turn it over to a collection agency, so the only thing its going to hurt is his credit.

The statement given to the police by me and the witnesses should be enough and the fact that he wasn't at the scene would be even more in my favor. Then the news about Progressive finding out that the guy had no insurance sealed it.

So far it seems a win but I'll see if the guy goes to jail or if he's gonna use the lame excuse that he didn't see me, lie about me saying the accident was nothing and so he drove off and telling them I short stopped.

So far my insurance company is being a bit quiet as I haven't gotten a phone call today. I really want my bike back ASAP but if it ends up being totaled out then I'm just gonna have to say goodbye to a bike that has taken me everywhere and how it was close to 40,000 miles. Then again if it is totaled out then I can buy a Ninja 500...

Okay, the rear swing arm may be bent, the back rim, fender, handle bar and shifter are gonna need replacing.

So far it's pretty close to being totaled... I get close to 3K for a 2001 Vulcan 500 that was pushing into the 39K mile mark...

I can get a Kawasaki Ninja 500 w/ 5K miles on it for $2500 (all US currency). Damn... gotta decide what to do...



* All right the bike has been totaled because they don't know how bad the bike is structurally and don't know if it'll be safe to ride so we came to an agreement that it's best to total it out. I will be getting the value of the bike along with generic value of windshield and saddle bags.

Not bad I guess but I created a lot of memories on that bike. I spent 38,000+ miles with her and 5 1/2 years. I worked on her myself, tuned her up myself, and just cruised for hours or days without care.


I am still responsible for the deductible since the other party has no insurance and they're trying to get it from him personally (he has a choice??). I also got word that it's not too likely he'll be punished badly or even at all by the police but it's UP TO the police, like the law doesn't even apply for a hit and run with no injuries or fatalities.

They said that if taken to court he could drag it on even though he's clearly in the wrong. WTF!



Ninja 500 here I come (still not very happy) since it's cheaper to buy and insure and it won't matter if it's a 2001 or 2009 because it hasn't changed so yay!

I'm really sorry to hear this happened to you.

As soon as I am in any accident I always take photos with my cellphone.
