Hypothetical Accident

I'm not planning on this happening, but I was curious. Suppose someone on a bike gets hit by a car, biker is OK, gear takes a beating and the cager is obviously at fault. The cager's insurance obviously will pay for the bike, or for repairs. What about the gear? I mean, I reckon between chaps, jacket, gloves, and helmet I have about $800 worth of gear on. Hell, that's worth more than my bike! Should the cager's insurance cover that? I do realize that if I were in such an accident I should be happy to be OK, but the insurance company should pay for replacement gear because they dont have to pay for a skin graft, right? Should the biker have to cough up $800 worth of new gear? Anyone been in this situation have some comments?

Funny you should post this. I was thinking about this just the other day when I dropped 290 on an Icon Motorhead jacket. I'd sure has heck try to get the Insurance company to pay for it, but who knows.

In my experience, yes they do pay for damaged riding gear. A guy from their insurance company came around and took pictures of all my damaged gear and that was that. I did have to call and harrass them about it first though.

The clause in most contracts reads something like this. " the liability lies with the the liable to return the damages to the original state before the accident." This applies if the liability lies with the other party. Should you be insured yourself and the liability lies with you the the insurer will only cover what is stated on the policy. You would need to specify your helmet, leathers ect on the policy.

When I had my accident, the cager was found at fault and her insurance co paid for the bike, leather jacket, chaps, helmet and gloves.
