HARLEY-DAVIDSON’S 2018 AMERICAN HEROES LEARN TO RIDE PROGRAM – TERMS & CONDITIONS

All federal, state, and local laws and regulations apply.  Harley-Davidson’s 2018 Military and First Responder Learn to Ride Promotion (“Program”) is void where prohibited or restricted by law.  Available for a limited time only. May not be available in all areas.  Limit one (1) offer redemption per person.  Riding course MUST start and finish between April 1, 2018 and September 30, 2018.  Registration for the Program opens April 1, 2018.

1. OFFER OVERVIEW

As a thank you to those who serve and protect our country and communities, Harley-Davidson is offering Eligible Service Members of the U.S. Military and Eligible First Responders (defined in Section 2 below), as well as the spouses of Eligible Service Members and Eligible First Responders, the opportunity to participate for $99 in one New Rider Course through a participating official Harley-Davidson Riding Academy between April 1, 2018 and September 30, 2018 (“Course”).

To participate in the $99 Riding Academy Course offer (the “RA Offer”), Eligible Participants must complete and submit the Offer Form (defined in Section 4 below), enroll in a qualifying Course on or after April 1, 2018 and complete the qualifying Course on or before September 30, 2018. See below for additional details and restrictions, including information for active-duty service members deployed between April 1, 2018 and September 30, 2018.

Alternate Offer: Eligible Participants, as defined below, residing and licensed in MT, ND, NY, OR, RI, or WY who do not have access to Harley-Davidson® Riding Academy will be eligible to receive, as an alternative to the RA Offer outlined above, a Harley-Davidson gift card in an amount equal to an Alternative Course fee minus $99.00. This Alternate Offer will require proof of completion a basic motorcycle riding course of comparable quality to the Course offered at an authorized Motorcycle Safety Foundation or other state accredited riding school (an “Alternative Course,” see Section 6 below for full details). Determination of an Alternative Course’s qualification for the Program will be solely determined by Harley-Davidson.

2. ELIGIBLE PARTICIPANTS

Participation in the Program, both the RA Offer and the Alternate Offer (each, an “Offer”) are limited to Eligible Service Members or Eligible First Responders, as defined below, who do not already have an “M” endorsement or license* to operate a motorcycle and who have not participated in the Program previously (collectively, the “Eligible Participants”):

A.   Eligible service members of the U.S. Military residing in the continental United States or Alaska and over the age of 18 at time of participation. “Eligible Service Members” are active-duty members of the U.S. Military, including the National Guard, U.S. Coast Guard, and Reservists, as well as individuals Honorably Discharged from any of the foregoing service branches, who have not participated in prior versions of the Program.  Individuals will be required to present valid U.S. Military ID, DD214 form, NGB22 form, or National Guard discharge papers (each of these, “Valid Identification”) to confirm eligibility.

B.    Eligible first responders residing in the continental United States or Alaska and over the age of 18 at time of participation. “Eligible First Responders” are current or retired:

i.            Law enforcement officers (including federal, county, city, capitol, state, village, and other local officers, sheriff’s department, FBI, secret service and motor patrol).  The determining factor in whether an applicant will be qualified under this category will be whether the individual has state-sanctioned, official “arresting power” as determined at the sole discretion of Harley-Davidson;

ii.            Firefighters (including full-time, part-time, paid on-call, and volunteers);

iii.            Certified EMS/EMT (including State-licensed Emergency Medical Responders, First Responders, Emergency Medical Technicians, Ambulance Technicians, Paramedics, etc.).  To qualify, individual must have EMT or EMS license; OR

iv.            Other emergency workers as approved by Harley-Davidson in its sole discretion.

PLEASE NOTE:  The following are specifically excluded from the Offer and participation in the Program:  those who have participated in the Program previously, dispatchers and EMDs, secretaries, office staff, prosecutors, administrators, customer service representatives, and healthcare workers other than licensed EMS/EMT (e.g., emergency room doctors, nurses, nurse practitioners, PTs, Red Cross First-Aid certifications, etc.).

Individuals will be required to present original, valid, and current Officer ID card or EMS/EMT license or certification (each of these, “Valid Identification”) to confirm eligibility.  Retired individuals must present a retirement letter from their department chief on department letterhead noting the individual’s service to the department.  Sufficiency of retirement letters will be determined at Harley-Davidson’s sole discretion.

C.    Spouses of Eligible Service Members or Eligible First Responders residing in the continental United States or Alaska and over the age of 18 at time of participation.  For purposes of this Promotion and Offer, a spouse is a husband or wife.  Husband or wife refers to the other person with whom an individual entered into marriage as defined or recognized under state law for purposes of marriage in the State in which the marriage was entered into or, in the case of a marriage entered into outside of any State, if the marriage is valid in the place where entered into and could have been entered into in at least one State.  This definition includes an individual in a same-sex or common-law marriage that either:  (i) was entered into in a State that recognizes such marriages; or (ii) if entered into outside of any State, is valid in the place where entered into and could have been entered into in at least one State.  A spouse who is either divorced or legally separated from the Eligible Service Member or Eligible First Responder through whom he/she is applying for the Offer (as of the time of application) is not eligible. Each spouse will be required to provide government-issued proof of identification (e.g., driver’s license, U.S. Military ID) (each of these, “Valid Identification”) and will be required to complete a form certifying that he/she is the spouse of an Eligible Service Member or Eligible First Responder.

To participate in Harley-Davidson’s Riding Academy, Eligible Participants will also need a valid automobile driver’s license and/or motorcycle learner’s permit (license/permit requirements vary by state), must have the ability to safely ride a bicycle, and must have and wear DOT approved helmet and other appropriate riding gear (see Section 4(d) below for full list of required gear). * PLEASE NOTE:  Offer available only to individuals who do NOT have an “M” (motorcycle) endorsement or do NOT have a license to operate a motorcycle. For clarity, individuals who otherwise qualify as Eligible Participants but already have an “M” endorsement or motorcycle license are NOT eligible for the Program. Notwithstanding the above, individuals licensed in Alabama with existing “M” endorsements who have not participated in the Program or another rider training course previously, may participate in the RA Offer.

3. OFFER PERIOD

The “Offer Period” is April 1, 2018 through September 30, 2018. This time period will be extended only for Eligible Service Members deployed for three months or more of the Offer Period who complete and submit the official Offer Form (defined in Section 4 below) during the Offer Period (“Deployed Service Member”). Special instructions for Deployed Service Members are below.

4. HOW TO PARTICIPATE – RA OFFER

Beginning April 1, 2018, to participate in the RA Offer, Eligible Participants must do ALL of the following in order to qualify for the offer (Alternate Offer participation terms listed in Section 6 below):

  1. Submit the Offer Form: Complete the Official Harley-Davidson American Heroes Riding Academy Program Form (the “Offer Form”).  Spouses of Eligible Service Members or Eligible First Responders will additionally be required to complete a spousal verification form (the “Spousal Verification”) certifying that he/she is married to an Eligible Service Member or Eligible First Responder.  The Offer Form can be accessed online at
    http://www.h-d.com/americanheroes.  After submission of a completed Offer Form Eligible Participants will receive a confirmation email including a promo code for the offer and Spousal Verification form to complete (if applicable).
  2. Register: Enroll in a qualifying Course with a participating Harley-Davidson Riding Academy Dealership (see www.h-d.com/ridingacademy for list of participating dealerships) and provide any required enrollment information including the promo code received in the Offer Form confirmation email.  Contact your local Harley-Davidson Riding Academy participating dealership for more information on available class times and to enroll in a qualifying Course.
  3. Confirm Eligibility: On or before the first day of the Course, present the confirmation email you received after submitting the Offer Form along with your Valid Identification, and Spousal Verification (as may be the case), to the Harley-Davidson dealership where you enrolled for the Course.
  4. Additional Requirements: To participate in any Riding Academy, Eligible Participants must (i) be able to safely ride a bicycle; (ii) have a valid driver’s license and/or motorcycle learner’s permit (license/permit requirements vary by state, so please confirm the requirements for YOUR state prior to enrollment); (iii) have and wear at all times all of the following required riding gear: DOT-approved helmet, full-fingered gloves, over-the-ankle footwear, long-sleeved shirt/jacket, eyewear and appropriate pants (jeans, chaps or leather pants); and (iv) fulfill any other safety or other requirements as determined by your local dealer.
  5. Complete the Qualifying Course. Qualifying courses must start on or after  between April 1, 2018 and  be completed by September 30, 2018.

Each Eligible Participant who fulfills all of the requirements above will be required to pay $99 for the Course.

*PLEASE NOTE: The process for enrolling in the Course may vary by state or between participating Harley-Davidson dealerships; please contact your local dealer for specific details. Some dealers may require a credit card number on file in order to enroll and hold a place in the Course. Registration in a Course reduces the number of spots available for other potential students; INDIVIDUALS WHO REGISTER FOR A RIDING ACADEMY COURSE AND THEN FAIL TO ATTEND WITHOUT INFORMING THE TRAINING PROVIDER IN ADVANCE MAY BE CHARGED THE FULL NORMAL COURSE FEE (TO CREDIT CARD ON FILE).

5. ADDITIONAL TERMS, CONDITIONS & RESTRICTIONS ON RA OFFER

RA Offer is limited to the $99 promotional cost of the Course; Eligible Participants are responsible for all other costs and expenses, including but not limited to required insurance and safety equipment.  RA OFFER applies only to Harley-Davidson Riding Academy Course; no other motorcycle training programs are eligible for the RA Offer.  For purposes of clarity, ONLY the New Rider Training will be considered for the RA Offer; all other advanced, skilled riding, moped, ATV or other courses are excluded.  Please note that the cost of each Course may vary based on geography and dealership, but the approximate retail value of the Course is typically $199 – $399.  In the event that a particular dealership offers the Course for $99 or less – whether on a regular basis or in connection with another promotion (i.e., non-RA Offer) – no additional cost reduction or compensation will be provided.

Enrollment in the Course is subject to availability, and class sizes may be limited both for safety reasons and to ensure the high quality of instruction.  If an Eligible Participant is unable to enroll in a Course within the Offer Period, no compensation or alternative benefit will be provided.  Dates, times, and locations for the Course will vary by Harley-Davidson Riding Academy, and may be subject to change or cancellation based on weather and other causes beyond Harley-Davidson’s reasonable control.  There is no substitution, reimbursement, or cash payback for Eligible Participants who have enrolled in any Course but, for whatever reason, are unable to attend, complete, or graduate from the Course within the Offer Period.

Eligible Participants participating in the RA Offer will be required to complete all necessary Riding Academy paperwork to participate, and agree to and abide by all Harley-Davidson Riding Academy rules, regulations, and requirements that may be in effect at each particular Riding Academy.  If, for safety reasons, an Eligible Participant requires more than standard adjustments to a training motorcycle (i.e., adjustments to the seat, suspension, and/or handlebars), that Eligible Participant may not be allowed to participate in the RA Offer, to be determined at Harley-Davidson’s sole discretion.

Eligible Participant may be required to present a valid driver’s license and/or motorcycle learner’s permit, as well as proof of insurance, before beginning the Course.  If Eligible Participant’s license (or permit) was issued from a state different from the state in which the Eligible Participant currently resides, additional restrictions/qualifications may apply. Affidavit of eligibility, tax information, and/or mutually acceptable liability releases may be required where not prohibited.

6. HOW TO PARTICIPATE – ALTERNATE OFFER.

Eligible Participants residing and licensed in MT, ND, NY, OR, RI, or WY (“Participating States”) will have the option of participating in the Alternate Offer by attending and successfully completing a basic motorcycle riding course at an authorized Motorcycle Safety Foundation or other state accredited riding school (“Alternative Course”). Determination of an Alternative Course’s qualification for the Program will be solely determined by Harley-Davidson.  Eligible Participants attending an Alternative Course will be required to successfully complete the Alternative Course and submit all documentation during the Offer Period. Upon successful completion of the Alternative Course, Eligible Participants must complete the Offer Form and provide all of the following to any participating authorized Harley-Davidson dealership located in a Participating State during the Offer Period:

•            Offer Form;

•            Valid Identification;

•            Documentation certifying successful completion of the Alternative Course; and

•            Receipt showing date and total cost of the Alternative Course.

Eligible Participants who have taken an Alternative Course will be issued a Harley-Davidson or Dealer-specific Gift Card in the amount of the Alternative Course enrollment fee minus $99 (not to exceed $500). The Harley-Davidson Gift Card is subject to certain terms and restrictions, available at www.h-d.com/giftcard, and will be issued by the authorized and participating Harley-Davidson dealer after all required documentation has been submitted. See Dealer for Dealer-specific Gift Card terms and restrictions.

Alternate Offer is limited to one (1) Harley-Davidson or Dealer-specific Gift Card; Eligible Participants are responsible for all other costs and expenses, including but not limited to the cost of the Alternative Course, and any required insurance and safety equipment. Harley-Davidson is not responsible for changes to or cancellation of any Alternative Course. If an Eligible Participant is unable to enroll in or complete an Alternative Course within the Offer Period, no compensation or alternative benefit will be provided.

7. SPECIAL INSTRUCTIONS FOR DEPLOYED SERVICE MEMBERS AND SPOUSES OF DEPLOYED SERVICE MEMBERS

Deployed Service Members may participate in the RA Offer by visiting http://www.h-d.com/americanheroes and completing and electronically submitting the Offer Form found there.  All Offer Forms from Deployed Service Members must be submitted during the Offer Period.  Deployed Service Members who submit their Offer Forms during the Offer Period will then be eligible to participate in the RA Offer upon their return to the United States.  To participate in the RA Offer, Deployed Service Members must follow the enrollment procedures for the Course outlined above in HOW TO PARTICIPATE (Section 4) and include a letter from their ranking officer stating they were deployed during the Offer Period and will then be sent a voucher good for one $99 Riding Academy course that must be redeemed by December 31, 2019.  Harley-Davidson reserves the right to contact Deployed Service Members or their ranking officer to confirm eligibility for the RA Offer.

Spouses of Deployed Service Members may participate in the RA Offer by visiting http://www.h-d.com/americanheroes and completing and electronically submitting the Offer Form found there. All Offer Forms from Spouses of Deployed Service Members must be submitted during the Offer Period. Spouses of Deployed Service Members who submit their Offer Forms during the Offer Period will then be eligible to participate in the RA Offer upon their spouses’ return to the United States, or at any time between April 1, 2018 and September 30,2018.  To participate in the RA Offer, Spouses of Deployed Service Members must follow the enrollment procedures for the Course outlined above in HOW TO PARTICIPATE (Section 4). If the Spouse of Deployed Service Member choses to complete the Course upon his/her spouses’ return to the United States, it must include a letter from their spouses’ ranking officer stating their spouse was deployed during the Offer Period. The Spouse of Deployed Service Member will then need to bring their confirmation email to their local dealership to receive a voucher good for one $99 Riding Academy course that must be redeemed by December 31, 2019.  Harley-Davidson reserves the right to contact Spouses of Deployed Service Members or Deployed Service Members ranking officer to confirm eligibility for the RA Offer.

8. PROGRAM LIMITATIONS; RELEASE

Limit one (1) offer redemption (either RA Offer or Alternate Offer, but not both) per Eligible Participant.  Participants in prior-year versions of the Program are not eligible to redeem Offer again in 2018.  The Offer may not be combined with any other promotional offer, and Eligible Participants who may also qualify under other Harley-Davidson Riding Academy offers may only participate once, regardless of eligibility for more than one Riding Academy Program.  Each Offer is non-transferable, and no substitutions, cash-outs, or alternative merchandise will be provided.  The Released Parties (defined below) are not responsible for any lost, late, delayed, or misdirected Offer Forms. Each Offer is strictly conditioned on Eligible Participants satisfying the requirements of these Terms & Conditions.

If, for whatever reason, an Eligible Participant does not meet the requirements set forth in these Terms & Conditions, including but not limited to (i) successfully enrolling in a Course (or successfully enrolling in and completing an Alternative Course, for the Alternate Offer), and/or (ii) timely submitting the required paperwork within the Offer Period, the Eligible Participant may be, at Harley-Davidson’s sole discretion, disqualified from participating in the Program. With respect to the RA Offer, “disqualification” will mean that the Eligible Participant is solely responsible for paying the full retail cost of the Course. With respect to the Alternate Offer, “disqualification” will mean the Eligible Participant will not receive the specified Harley-Davidson or Dealer-specific Gift Card.

By participating in the Program, Eligible Participants agree to accept and abide by these Terms & Conditions and agree that any dispute with regard to the conduct or administration of this Program or the interpretation of these Terms & Conditions shall be submitted to Harley-Davidson, whose decision shall be binding and final.  By participating in this Program, Eligible Participants further agree to release and hold harmless Harley-Davidson Motor Company, Inc. and its dealers and retailers, affiliates, sales representatives, distributors and promotional and other vendor agencies, their respective parent companies, affiliates, subsidiaries, service agencies, independent contractors, and the officers, directors, employees, agents and representatives of any of the above organizations (collectively, the “Released Parties”) from any injury, loss or damage to person, including death, or property due in-whole or in-part, directly or indirectly, to participation in this Program or participation in any Program-related activity.

Harley-Davidson is not responsible for any typographical or other error in the printing of any Offer, administration of the Program, or errors relating to the announcement of eligibility or qualification for any Course.  If for any reason Harley-Davidson is prevented from continuing with this Program, or the integrity and/or feasibility of the Program is severely undermined by any event including but not limited to fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state or local government law, order or regulation, order of any court or jurisdiction, Harley-Davidson shall have the right, in its sole discretion and without incurring any liability, to abbreviate, modify, suspend, cancel or terminate the Program without further obligation.  If Harley-Davidson in its discretion elects to so abbreviate the Program, Harley-Davidson reserves the right, but not the obligation, to honor eligible Offer entries received to date. Harley-Davidson reserves the right to change or terminate the Program at any time, without notice.

8. DISPUTES/CHOICE OF LAW

EXCEPT WHERE PROHIBITED, EACH PARTICIPANT AGREES THAT: (1) ANY AND ALL DISPUTES, CLAIMS, AND CAUSES OF ACTION ARISING OUT OF OR CONNECTED WITH THIS OFFER SHALL BE RESOLVED INDIVIDUALLY, WITHOUT RESORT TO ANY FORM OF CLASS ACTION, AND EXCLUSIVELY BY STATE OR FEDERAL COURTS SITUATED IN MILWAUKEE, WI, (2) ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, BUT IN NO EVENT ATTORNEYS’ FEES; AND (3) NO PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR OTHER DAMAGES, INCLUDING WITHOUT LIMITATION, LOST PROFITS, MAY BE AWARDED (COLLECTIVELY, “SPECIAL DAMAGES”), AND (4) ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM SPECIAL DAMAGES AND ALL RIGHTS TO HAVE SUCH DAMAGES MULTIPLIED OR INCREASED. WISCONSIN LAW, WITHOUT REFERENCE TO CHOICE OF LAW RULES, GOVERNS THE OFFER AND ALL ASPECTS RELATED THERETO.

9. PRIVACY

Personally identifiable information that is submitted by participants as part of this Program will be used to administer the Program and will be treated in accordance with Harley-Davidson’s privacy policy accessible at http://www.harley-davidson.com, as revised from time to time.


10. INSTRUCTIONS FOR PARTICIPATING DEALERS

Please see h-d.com/americanheroes or Promotion 484 landing page on H-Dnet.com for details on participation in the Program. Dealers must close completed courses in the Student Management System within thirty (30) days of each Course being completed in which an Eligible Participant is enrolled.  COURSES WITH ELIGIBLE PARTICIPANTS ENROLLED THAT ARE CLOSED MORE THAN THIRTY (30) DAYS FROM THE COMPLETION OF THE COURSE WILL NOT BE ELIGIBLE FOR REIMBURSEMENT. 

The following items are needed for your submission to be issued credit.  Any submissions not submitted in full will not receive credit.

Riding Academy:

  1. Offer Form Promo Code must be entered on Eligible Participant’s registration form in the dealer’s Student Management System. If Eligible Participant registered for Course online, this will be automatically entered on the dealership’s behalf in the Student Management System. If student registered for Course online, dealer must still verify this Promo Code is present. If student registers with dealer either over the phone or in person, dealer is responsible for entering Offer Form Promo Code in the registration form in the Student Management System manually. NOTE: The Promo Code is case specific to each customer and will adjust the student’s course cost to $99.

2.       On or before the first day of the Course, dealer must verify student is eligible for the RA Offer by checking the student’s Valid Identification (details found in Section 2) or Spousal Verification (as may be the case). Dealer must then check the Student’s Identity Validated   box on the student’s registration record in the Student Management System. If this box is not checked the dealer will not be reimbursed for RA Offer.

  1. Once the Course has been completed, dealer must close the Course in the Student Management System within thirty (30) days of the completion of the Course
  2. Once class has been closed, Harley-Davidson will be able to view transaction history through the Student Management System to credit dealer for the completed course

DO NOT copy the Eligible Service Member’s or Eligible First Responder’s Valid Identification.  Photocopying documents of this nature may be prohibited by law.
