At the bottom of what? But either way, Tom Petty can "fudge" himself, because the RHCP rock, I have tickets to see them in october, and bought Stadium Arcadium the day it came out.

Their new single Dani Californioa apperently sounds like Last dance with mary Jane... I can hear a similarity, but not enough to get Toms panties in a twist over.... But plagerism laws can be fairly broad I guess.
And it's not like this is the first time to hit songs have sounded similar.
A dog had his chain reduced one link at a time, every few days, until his chain was so short he could barely move. He never resisted because he was conditioned to the loss of his freedom slowly, over time. Are we in this country becoming like the dog?

After reading the article, it sounds like the producer should be sued if anyone (although, I don't hear such a strong resemblance either). He's the one who worked with both songs and the one who makes the suggestions for changes in the studio. Regardless of whether the songs are too similar or not, why the hate fest on Tom Petty? The article even states that he has made no comment and has not mentioned plans to sue anyway. Tom Petty rocks, and he's one of the nicest folks IRL. The RHCP are great, but if there truly was a plagiarism issue, don't you think that the original writer should have protection for his/her artistic material?
My favorite plagiarism case ever was when CCR wanted to sue John Fogerty. The songs were CCR's "Bad Moon Rising" and John Fogerty's "The Old Man is Down the Road". Thing was... John Fogerty wrote both songs. So basically he was being sued for plagiarizing himself. The case was thrown out.
