It sucks that he actually wrote it for 46. If you have 0 points and no tickets in the last three years ask for a prayer for judgement and see if you can go into a defensive driving class rather than get the points on your license. You will still have to pay the fine but it shouldn't go on your insurance and again no points. Usually, you can ask the magistrate at your court date. Ask around your area. Odds are someone you know has done it.

Also, you were speeding regardless of whether the zone had just changed. You were either doing 6 over or 16 over. So, I wouldn't bring that up to the magistrate.

also, many tickets have a two spots two sign. I admit guilt ______. Nolo Contendere ______. Some even have a Not Guilty________. In criminal law, which this is for purposes of court talk, a plead of not guilty is not held against someone even if they turn out to be guilty as our system is very favorable for the defendant.

For a traffic ticket, however, that presumption isn't quite as strong and you may very well irritate a judge for signing not guilty and then fighting it court. When available, I reccomend Nolo Contendere, which means I will not contest. You can then show up and try to explain to the judge how good looking you are or how unfair it was and try and get an improper equipment ticket instead.

What you sign on a ticket is not the end of the analysis. When being brought in for criminal charges, though admissible, what you signed has not been brought before a judge as an arraignment or pleading. If the judge asks you how you plead in court, that is when you go for the Not guilty, your honor.

If you have a superbike and your insurance is already high and you do not have many other tickets go give 250 dollars to a lawyer and he will get you improper equipment...almost guaranteed.
Shop around for lawyers, you will get someone cheap for this and this does not require much skill..they all know how to do it and youll end up with your non moving violation.

Yeah you are probably right about that.

Yeah I agree man, he really didn't want to listen to my side of the story at all. HE just got out and was like "Where are you going in such a hurry?" all I could think was "Ah crap I'm dead".

dude i wouldn't worry so much. A couple months ago I received a speeding ticket on I25 for six points. The city attorney I spoke with was very nice and explained that a six point speeding violation could result in a $300 possible fine and three months prison time for maximum penalty. But she reduced the fine to $100 pending 4 points against my license. And no mandatory jail time luckily,

. After speaking with her, she submitted my file to the judge, they called me up, and sent me directly to the county clerk. I didn't have to speak with a judge, and they only charged me $82 total after court fees, which was obviously reduced even more from $100.

So I feel I was practically spoiled for committing such a moving violation on a bike. And I was going pretty fast....fast enough that I won't share with everyone. But Colorado is a biker friendly state, so who knows brack. Best of luck to ya, and SLOW YER "O Ring" DOWN!!!

First thing I would do is to ride back through and actually see if there is a lower posted speed limit sign. If not show up in court on your assigned court date. If it is posted just pay it and be done with it.

I was thinking about doing that but I think siralienj is right. Even if I was only doing 6Mph over what I thought the speed limit was I was still technically speeding.

I think the majority of America does 5Mph over the speed limit. But I don't think telling the judge would help that.

I had a ticket for 6 over outside of Roanoke Va. I pled no contest and was allowed to take traffic school. After taking traffic school and returning I given a clear record and no fines. I guess taking traffic school and driving from hampton va 265 miles away was considered enough.

However, I didn't pay my $0 fine and they suspended my license. I kid you not

I had to drive out to roanoke, pay my $0 in person b/c they don't accept <$5 charges on credit cards then pay $80 to have my license reinstated. Now my record shows a suspended license. Only in Virginia

Woah...a $0 fine??? how the heck do they do that? I mean are you talking about like less than a dollar fine?

No- as in I had to pay them 0 dollars. I literally had to write a check for $0.00
