New led tail light legal opinion

I saw a ad for a replacement rear brake light blub. It uses led's and when the brakes are off alternates clockwise/counterclockwise and when brakes are on pluses a straight line.

So is it legal (or how can I find out) to have rear brake light be anything but off when the brake is not applied?

In Va we'd have to contact the state police as they are the experts on inspections and what is both allowed and restricted on street vehicles. Make a few calls to the DMV, state police and inspection centers and you should get an answer. However, if they are DOT approved chances are that you're ok using them.
