Low oil is never good. It certainly didn't help your problems.
Bent linkage could be a cause or effect of a bent shift fork. If whatever bent the linkage in the firstplace was a good, sharp hit (dropping the bike), it could have also bent the shift fork at the same time. That would be a cause.
If the fork was bent due to repeatedly missed first-to-second gear shifts (common on some bikes, ridden hard), the rider will often shift with more force than normal to try to 'get the blitch in there'. Over time this wears the piviots and can bend the linkage. That's an effect.
Either way, it means splitting the cases and major cash donations. The parts will be the cheapest part of the ordeal. The labor is what hurts. But it's not something the average home wrencher can do unless they have the experiance and skill. It is very easy to wreck more than you went in to fix if you don't know what your doing.

No Witnesses....

Does it shift fine into the other gears? If it does, then you are screwed my man.
The tranny would not be the first component to be effected by low oil. And jumping out of gear would not be one of the symptoms.
No ill meaning implied, but I have to laugh when I read your line, "Ride it like you stole it," because that is the surest way to jam up your transmission.
I said this in another post...if you decide to fix this problem. It will be expensive because I recommend you replace everything. A transmission job is one that you want to do right the FIRST time. I replace all the shift forks because they will all show wear and the shift fork shafts. All gears that show considerable wear, which will be many. And the shift drum. The rest of the expenses will be all the gaskets and lock washers. You should expect the DEALER to charge around 10 hours for this job. And this is a job you will want a qualified technician to perform...not one of your buddies down the street.
Good luck with this...and if you do not want to fix it, just bypass second gear. I had a customer do this on his V65 Magna, but with the torque that bike had, second gear really was not missed. Thats not the case with your CBR.

im not sure if it has low oil or not. im not sure if the bike has been dropped or not. i actually havnt even ridden the bike; its in the process of being bought, but the guy im buying it from says hes going to pay for the bike to get running good (he also knows a guy that owns a honda dealer). im pretty sure the tranny shifts to all other gears fine, but it just keeps popping out of second.... its starting to "pee" me off
