that's what I'm doing and have already done. And you're right the code I've cited (the one I was written for) doesn't say anything about location or visibility. The "not mounted at the rear argument" was the only one I could come up with too, but that would/should have been written as "improperly mounted"

I'll be taking plenty of photos with me along with current photos to demonstrate how I've repeatedly tried to comply and am currently trying to.

If it was ME..... i'd put it on top of a long pole, right above a large banner with that code printed in big letters on it.

I would definitely fight this. Judging by the picture, as long as there is light on the tag then it shouldn't be an issue. Think about those guys with customs with sidemount plates. I bet you anything, you can't see the plate from the right side and not to mention how much lower the plate is mounted. I had to fight a similar incident with my old Mazda Rx-7. I had replaced the original "pop-up" headlights with DOT approved fog lights. The cop wrote me a ticket for it. I went to court with pictures of how bright the lights are and even the sight range of the lights from the driver's seat and the judge dropped the ticket.

It appears to me those codes only indicate that the plate has to be mounted somewhere on the back of a motorcycle. I don't see anything saying it has to be visible from a certain distance. This is one to bring to court and you need to use the states own words/rules as they are written against them.

As someone else on that cop board mentioned how many plates are visible on tractor trailers ? Why don't they get tickets as well ?

Maybe as was mentioned before, when you sit on the bike asnd compress the springs it obscures it a bit?
